campbell. the gunman accused of unleashing a deadly shooting rampage that killed 12 people at a colorado movie theater appeared in court for the first time today. the 24-year-old suspect was silent and spent much of the grief hearing looking down with a dazed look on his face. fox reporter alissia acuna is in central colorado to explain why it could take so long to find the motive. >> james holmes, making his first court appearance today, investigators say holmes is refusing to cooperate, and it could take months to learn exactly what prompted the attack on movie goers at the midnight "batman" film days ago. >> ordinarily individuals are titled to bail. given the nature of the charges, you are currently being held on a no bond hold. >> i just have all this anger built up. >> reporter: two girls who were in the theater in the shooting, one with a bullet lodged in her chin, say they want to be in court to see holmes begin to

face the justice system. >> for how much hurt he's done to this whole state and nation, i mean, i don't think he's hurting yet, and i think he needs to. >> i definitely have had my moments where i just completely lose it, and so we'll see what happens when i actually see him. >> reporter: police say they have cleared out all of the hazardous materials from holmes' apartment, much of which will be used as evidence. investigators say holmes started stockpiling guns from denver area stores almost two months ago, and even tried to become a member of a gun range last month. >> i would say there's no such thing as a slam dunk case. it is a case where we're still looking at the enormous amount of evidence and we would never presume that it would be slam dunk. we will work very hard on this case to prosecute it just like we would any other case. >> reporter: the prosecutor says holmes could face the death penalty. however, that decision could be weeks or months away and will require some consulting with the

victims and their families. in centiniel, colorado. >> many family members of the shooting victims went to court to get their first look at james holmes. relatives were escorted in. there's word today that a 21-year-old pregnant woman who narrowly escaped friday uninjured is in labor with the baby expected to be delivered today. the woman's husband was shot in the head and remains hospitalized in critical condition. we will have continuing coverage of the shooting and its after math on every ktvu newscast. we also have additional photos and videos on the aurora massacre tab on ktvu.com. customers of the california department of motor vehicles are encountering long lines and slow online service because of computer problems. we found customers lined up outside the door this morning at one san francisco dmz office.

computers were off line when the office was supposed to open due to a power outage and that's causing a big backup. visitors were also met with a warning that online service is slow. the state's technology office had a power outage over the weekend that affected hundreds of state and local agencies. >> royally messed everything up for everybody and when i got here for my 10:20 appointment, there was already a line out the door and they weren't letting people in right away and people were cranky. >> the dmv had a similar online problem a month ago. the california technology office told us the problem will not be cleared up for two to three hours. police in san jose are searching for at least one gunman after discovering a man and woman shot to death inside a home. ktvu's jeanne dela vegga joins us with new information.

good afternoon. >> reporter: good afternoon. in the last couple of minutes, the coroner removed both bodies out of this house that you see in the 300 block of north seventh street. it was very emotional out here. the family had arrived a short time ago to find out that one of their loved ones was dead. the family is in shock. a man and a woman we're told lived here together. it's unclear if they were married but we are told by neighbors that they were a couple. we're told that they have three children and that all of those children are now at the police department. now, police say the gun shots were fired at 4:20 this morning and when they arrived, they found two bodies inside. police spent the morning searching the area for the shooter but they turned up empty handed. it's unclear if there was forced entry into the home or if the victims knew the shooter. neighbors are reeling over the death of their neighbors. this woman we spoke to said she's too scared to show her face on camera. >> she's a good lady, good

friend, and when i saw her working with the kids, she told me hi, hola, and this and that, and she's nice, and that's not okay that these people do this. >> reporter: now, police called a tow truck to the scene to take this suburban off, we're assuming for evidence because officers tell us it's somehow connected to this double homicide. they do not believe it's a murder suicide. some evidence they found tells us that it is definitely a double homicide. back live at the scene, you could see the house, the window was completely blown out from gun shots and you can see the ply wood that was put up there, and police are winding down their investigation. some police cars just drove away. we're told by a spokesperson from the department that this makes the 21st and the 22nd homicide of the year for san jose. reporting live from san jose, janine de la vegga, ktvu channel

2 news. >> thank you janine. the red cross is helping at least a dozen people displaced bee a san jose apartment building fire around 9:00 last night. five people were treated for minor injuries. firefighters say there is no sprinkler system and flames quickly spread through the densely populated complex. they also say trucks were hard to get close to the fire because of the design of the building. >> crews had to start their initial attack from the adjacent shopping center. that was the closest access point for us to get hose lines to the fire. >> just started getting out of control. the tree started catching on fire up top so the first thing was like get my kid out of there. >> reporter: it took more than 90 minutes for them to control the flames. the cause is under investigation. >> there was another apartment fire this morning, this one in san francisco. we'll tell you about that in about nine minutes and let you know how many people lost their homes. the president's bay area

visit today took an unexpected twist. that's because the president arrived last night instead of this afternoon. he just left for a brief visit to nevada but will be returning again. tara moriaty joins us live from sfo to explain this back and forth itinerary. >> reporter: the president is expected to land in reno any moment and will be back this afternoon in oakland. let's take a look at some pictures taken of him earlier as he boarded air force 1. he's supposed to arrive at 3:00 this afternoon where he'll attend three fundraisers, the big one being at the fox theater. many businesses nearby have put up green flags in support of medical marijuana advocates angry over recent federal government crackdowns. one merchant we've spoke to says she's thankful the president put the spot light on a city that deserves attention. >> i think it's a great day for oakland in particular,

african-american communities getting to see him. i'm excited to get a glimpse. i'm grateful. >> reporter: marine 1, the president's helicopter was fired up this morning. it will be used if a backup mode of transportation is needed. he arrived at sfo a day early due to last minute changes after stopping in colorado to speak at a vigil for victims killed in the aurora tragedy. the president traveled with more than 50 people and there are hundreds to support the effort it takes to get him places so it was easier we're told to go to a city that was prepared for him to stay the night. that's why he didn't stay the night in colorado. the president will stay in the bay area one more night before he heads to portland, oregon, tomorrow morning. live from sfo, tara moriaty, ktvu channel 2 news. >> thank you, tara. the president's visit has already led to street closures in oakland today. 17th street, telegraph avenue, and 20th street is blocked off. vehicle and pedestrian traffic, as well as parking, are off limits on those streets. they should reopen by 10:00 p.m.

and the 17th street entrance to the 19th street bart station is also closed. for those who didn't get word of the street closures, they're in for a big headache. crews were out towing cars this morning that remained parked along those closed streets. republican mitt romney is preparing for small business round table in orange county right now, in fact expected to begin a little over an hour from now. he held a fundraising breakfast in irvine this morning. the round table is set for 1:30 in coasta mesa. that comes after he attended three fundraiserses in the bay area yesterday, one in woodside and two in san francisco. it has been a tough day on wall street with a significant drop in stock. fears over european debt have resumed with a vengeance. the dow is currently down 127. though earlier, it was down over 200 points, the nasdaq down 40, s & p down 15. amid a deepening financial crisis, protesters took to the streets in spain over the

weekend. they are upset over budget cuts and high unemployment. the protests come as the euro dropped today to its lowest level against the yen in nearly 12 years, and the euro hit a two year low against the us dollar. spain's barring costs soared to 7.3%. euro's own finance ministers have detailed a bail out for banks but some are afraid that might not be enough. historically unprecedented actions by the ncaa today are warranted by the conspiracy of silence. >> the hammer falls on penn state. we'll outline the punishment after the university's child sex scandal. >> steve paulson is up soon to tell you if the warm up we saw over the weekend is over. and the celebration today as bay area transit systems get a major boost. great idea. so we'll switch to u-verse tv and internet...

emergency crews had to use the jaws of life to rescue a driver who was hit by a big rig just after 3:00 this morning on 238 as both vehicles were leaving 880. the big rig driver slammed into a honda accord sending that car into the center divide. the driver of the honda has a

broken arm and minor injuries. the chp is investigating the accident and says the big rig driver was at fault. an oakland police officer has been released from the hospital after his patrol car collided with another vehicle and then rashd into a building. it happened shortly before 1:00 a.m. at east 18th street and park boulevard. police are still trying to figure out what caused the crash. the police car ended up inside an h & r block office. the officer was taken to the hospital with minor injuries. no one else was hurt. oakland police are also still looking for the cause of a house fire that gutted a home. it happened on 78th avenue around 9:20. two people who were in the house at the time got out safely. it took about 20 minutes to control the flames. firefighters say it appears the fire started in the kitchen, but again, they are still looking for the specific cause. san francisco firefighters this morning scrambled to put out a two alarm fire in the city's mission district. the fire broke out in the attic

of an apartment building. the occupants escaped without injury. some residents tell ktvu firefighters were called to the building yesterday on the report of a fire in the attic. fire officials have not yet confirmed that information. santa clara county's district attorney says he will pursue reduced sentences for some inmates sentenced under california's three strikes law. jeff rosen tells the mercury news that the inmates are serving life sentences for third strike convictions that were minor offenses. a measure modifying california's three strikes law will be on the november ballot. if passed, it would impose life sentences, only when a new felony conviction is serious or violent. the ncaa is hitting penn state with an unprecedented number of sanctions in the wake of the jerry sandusky sex abuse scandal. the ncaa's president this morning announced the sweeping penalties which stopped short of shutting down the university's

football program altogether. penn state faces a hefty fine equivalent to the annual gross revenue of the football team. >> the ncaa is imposing a fine of $60 million on the university with the funds to be used to establish an endowment to support programs around the nation that serve the victims of child sexual abuse. >> the college sports governing body is also banning penn state from any bowl games or postseason play for four years. in addition, victories from 1998 to 2011 will no longer be counted, and that means the late joe paterno loses his title as college football's winningest coach. the university will also lose 20 athletic scholarships per year over four years. more than 20,000 aids experts and activists are gathered in washington dc this week for the international aids conference. attendees include former president clinton and former

first lady laura bush. this is video of yesterday's opening session. singer elton john this morning made a surprising appearance on the national mall to view the aids quilt which originated in san francisco and he read some names from it. the conference runs through friday. bay area transit agencies will soon be getting more than $45 million in federal grants. deputy federal transit administrator terese mcmillan made that announcement this morning while standing in front of a muny bus in san francisco. the money will go to a number of bay area agencies. san francisco and other cities will use it to replace old diesel busses, among other projects. the grants total $787 million nation wide. >> we look forward to working with all of you as we continue to invest in the transportation systems across the country and the need we have to grow and compete, providing opportunities that all americans deserve. >> the federal grants will also go to improve bus service and

safety. bart plans to install realtime video monitors in more than a dozen stations telling passengers the exact time the next train will arrive. the monitors will be in addition to the signs on the platforms that will be located in gate areas as passengers head for stairs and escalators. bart says the monitors will help people know if they need to hurry to reach the platform or if they can take their time. bart is using a federal grant to pay for the screens and hopes to have them installed by 2014. one though has been up for two years at the empbark dero station as an experiment. we have images to show you of lightning in northern california. a ktvu viewer named lorette took this photo of a lightning strike over night. this was halfway between rancho cordova and lake tahoe on highway 50. the strike just lit up the dark sky. we have also some video of lightning and rain. this is rancho cordova just

outside sacramento, which saw significant rain and several lightning strikes. the storm cell has since moved farther up into the sierra and the tahoe area. well, a lot of those tropical clouds and the increase in the fog and sea breeze all associated with a low pressure system that's decided to move up the central california coast, right over the bay area so the tropical clouds were close. you can see some of them and there was some lightning off in the distance. most of the heavier activity is up in the sierra nevada. renno has some boomers, southlake tahoe, and bridge port. now we probably don't have to worry about it anymore. sea breeze though, it was blustery this morning. from cordellia to fairfield. and even towards vacaville. that's a sign cooler weather is on the way. 70s and 80s. livermore in the hot spot.

temperatures down definitely compared to saturday and sunday. san jose is 78 degrees and throughout the week, it looks like the cooling trend will continue. one low here will move off and be replaced by another. keeps deepening, and we'll see temperatures starting off this week in the 60s, 70s, 80s, and 90s while inland and a lot more 80s, and on our cloud-rain forecast, the rain stays up in the sierra nevada. look at the fog on the coast for tuesday. keeps getting a little thicker and thicker and will continue to fill in. a few high clouds off in the distance. breezy to windy, cooler than most. we'll go 80s and 90s, still out by antioch, brentwood, oakley, you can see 90s out there. other areas, 70s and 80s and 60s closer to the coast. the message here is for a cooler pattern. tuesday, wednesday and thursday

stocks lower on wall street and around the world today. the main reason, worsening problems in spain, prompting rising concerns that the fourth largest country that uses the euro will be next in line for a bail out. the dow down 115, the nasdaq down 40, snp down 15. oil down $2 down to $91 a barrel. apple and facebook will release their earnings reports this week. apple will report tomorrow. the company is expected to post another quarter of strong profits. facebook reports on thursday, the first report since the company went public back in may. san jose's gaming commission expects to make a decision by the end of the week on a permit for a gambling establishment called casino matrix. that word comes after a public hearing at which no one spoke. the card room is a reinvention of san jose's old garden city casino. it was supposed to open in april but the owner was not able to get a permit in time. if the city approves the permit

this week, casino matrix could open by the end of the month and provide 300 jobs to the area. oakland city council has repealed an 82-year-old ban on dance marathons. according to the san francisco chronicle, the city council voted in favor of the repeal last week. the marathons were strictly for die hard dancers. they would last for weeks with people dancing nonstop and only taking a $15 break each hour. now, dancers can kick up their heels for as long as they want. uc berkeley is working to give students more access to online education. this is a program that gives uc students the opportunity to take online classes. it started in january and offers 10 courses ranging from general education to science. this fall, the university will add four more classes and continue to develop 30 more. today on ktvu channel 2 news at 5:00, as we mentioned, president obama is due back in
